Legal
Acceptable Use & Prohibited Items Policy
Effective 5 November 2026
This policy sets out what may not be sold, listed, uploaded or done on Slaby, what may only be sold with a licence, and what happens when the rules are broken. It applies to every store, staff member and user of Slaby, on storefronts, the shared marketplace, counter billing, digital products and messaging. It forms part of the Terms of Service (slaby.in/legal/terms) and the Merchant Agreement (slaby.in/legal/merchant-agreement). Following this policy does not replace your duty to follow the law; where the law is stricter, the law applies.
1. Prohibited items
You must not list, sell, offer, promote or arrange delivery of any of the following through Slaby, in any form, physical or digital:
(a) Narcotic drugs, psychotropic substances and controlled substances under the NDPS Act, 1985, and drug paraphernalia; prescription medicines, and any medicine sold without the licence and prescription the Drugs and Cosmetics Act, 1940 requires.
(b) Firearms, ammunition, explosives, fireworks without the required licence, and weapons or parts restricted under the Arms Act, 1959, including knives and other items the law restricts.
(c) Counterfeit, replica, "first copy" or "master copy" goods, and anything that uses another person's trade mark, design or brand without permission.
(d) Stolen goods, or goods you do not have the right to sell.
(e) Wild animals, birds and plants, and their parts or products (such as ivory, skins, horns, shells, feathers or corals), protected under the Wildlife (Protection) Act, 1972 or traded in breach of CITES.
(f) Human remains, body parts, organs, tissue, blood or other bodily fluids.
(g) Electronic cigarettes and other electronic nicotine delivery systems, and their parts and refills, which the Prohibition of Electronic Cigarettes Act, 2019 bans; tobacco products sold in breach of COTPA, 2003 (for example to people under 18, or without the required warnings).
(h) Alcoholic beverages, unless you hold the licences the relevant State requires and online or delivered sale is permitted where both you and the buyer are located.
(i) Lottery tickets, betting, wagering or gambling services, and anything that facilitates them.
(j) Sexually explicit or pornographic material, sex services, and any obscene content under the Information Technology Act, 2000 or the Indian penal law. Child sexual abuse material is never tolerated: we remove it, preserve evidence, terminate the account and report it to the authorities.
(k) Content or goods that promote hatred or violence against people on grounds such as religion, caste, race, ethnicity, gender, sexual orientation or disability; that support terrorism or violent extremism; or that threaten the unity, integrity, defence, security or sovereignty of India, or public order.
(l) Fake, forged or altered documents, identity cards, certificates, degrees, licences, number plates, uniforms or badges of government authorities, and services to obtain them.
(m) Hacking tools, malware, spyware, stalkerware, phishing kits, cracked or modified software, stolen licence keys or accounts, and devices meant to jam signals or bypass security.
(n) Lists or databases of people's personal data (such as phone numbers, email addresses or identity details), however obtained.
(o) Items or services whose sale is banned or restricted by the Government of India or a State, including items under export or import bans, and currency or coins that are legal tender (other than for genuine numismatic sale where lawful).
(p) Ponzi, pyramid or multi-level-marketing schemes, chit funds without registration, unregistered investment or trading-tip services, cryptocurrency or token schemes promising returns, "guaranteed income" offers and other money scams.
(q) Products, remedies or content that claim to cure, treat or prevent diseases or conditions in breach of the Drugs and Magic Remedies (Objectionable Advertisements) Act, 1954, or otherwise make false or misleading health claims.
(r) Pirated software, films, music, games, fonts, courses, e-books or other copyrighted material you do not have the rights to sell, and resell-rights (PLR / MRR) bundles, "mega packs" or other material bought only to resell without real rights to it.
(s) Anything else that is illegal in India or in the place it will be delivered.
2. Restricted items: licence first
The following may be sold only if you hold the licences, registrations and approvals the law requires, display them where the law requires, and follow every condition attached to them. We may ask you for proof at any time and remove listings until you provide it.
(a) Food and beverages, including home-made food — FSSAI licence or registration, with the number displayed.
(b) Cosmetics — manufacturing or import registration under the Drugs and Cosmetics Act, 1940 and the Cosmetics Rules, 2020, with correct labelling.
(c) Ayurveda, Siddha, Unani and Homoeopathy products — the licences required under the Drugs and Cosmetics Act, 1940, and no claims beyond what the law allows.
(d) Medical devices and diagnostic kits — registration or licence under the Medical Devices Rules, 2017.
(e) Alcohol — as described in the prohibited-items list above.
(f) Gold and silver jewellery and artefacts — BIS hallmarking where it is mandatory.
(g) Products under BIS compulsory certification or quality-control orders (such as many electrical goods, toys, helmets and pressure cookers) — the required ISI or other mark.
(h) Seeds, fertilisers, pesticides, pet food and veterinary products, plants and animals that may lawfully be sold — the licences or registrations their laws require.
(i) Wireless and telecom equipment — the certifications (such as WPC or TEC) the law requires.
(j) Any other item for which the law requires a licence, registration, age check or label.
3. Digital products
Digital products are delivered from Slaby's own links, so one store's files affect every store. On top of the rules above, you may sell as a download only content you made yourself or hold the full rights to sell — such as your own e-books, guides, courses, workbooks, templates, presets, music, art, photos, videos and software.
The following are not allowed as digital products: content that teaches manipulation, coercion, abuse, stalking or harassment of other people; sexual or adult content of any kind (stories, images or videos); pirated or copied material — books, courses, films, music, fonts or software made by someone else that you don't own the rights to; resell-rights (PLR / MRR) bundles, "mega packs" and other files bought only to resell; cracked or modded software, licence keys, hacking tools, malware or any file that can harm a device; leaked exam papers, answer keys or other confidential documents; lists of people's personal data; guaranteed-income, trading-tip, betting or get-rich-quick schemes; health, medical or diet content that claims to cure or treat a disease; and anything illegal in India, hateful, or that promotes violence or self-harm.
Before a store can sell digital products, its Owner must accept the digital-products content policy shown in the store admin, and we may require a review and approval of the store. We review new digital products and their files, may scan files automatically, and may refuse, pause or remove a product. Buyers can report a digital product to us.
4. Listings, pricing and reviews
Listings must be accurate and not misleading: real photos or fair representations, correct descriptions, quantities, specifications, country of origin and condition, and every mandatory declaration.
Prices must include all taxes and show any extra charges before checkout. Do not show a fake "original" or MRP price to inflate a discount, change prices in a way that misleads buyers, or advertise stock or delivery times you cannot honour.
Do not post, buy, solicit or reward fake reviews or ratings, remove genuine negative reviews to mislead buyers, or review your own products while posing as a buyer.
5. Messaging and marketing
Send promotional WhatsApp messages, SMS and emails only to people who agreed to receive them from your store, follow the rules of each channel (including WhatsApp's commerce and business policies and TRAI's rules on commercial communications), and stop at once when someone opts out or replies STOP.
Do not send spam, chain messages or bulk messages to purchased or scraped lists, and do not use Slaby to send messages that are deceptive, threatening or harassing.
6. Conduct and the platform
Do not impersonate another person, business, brand or government body, or misrepresent your identity, location or affiliation.
Do not infringe copyright, trade marks, designs, patents or other rights. Use only images, text, videos, fonts and music you own or are licensed to use.
Do not scrape, crawl or harvest data from Slaby or other stores beyond what our robots rules allow; probe, scan or test the security of the Service without our written permission; attack, overload or disrupt the Service; get around rate limits, plan limits, moderation or access controls; or access another store's data or accounts.
Do not use Slaby to collect payment for goods or services that are not sold through your store, to launder money, or to process transactions for another business.
7. How to report a problem
Anyone can report a listing, product, store or message that breaks this policy or the law. Marketplace listings carry a report option, and each store's /policies page links to slaby.in/legal/grievance. You can also write to the Grievance Officer named at slaby.in/legal/grievance, which lists the address for copyright, trade mark and unlawful-content (takedown) notices.
Please include your name and contact details, the link to the store or product, what is wrong and why, and — for an intellectual-property complaint — proof that you own the right or are authorised to act for the owner. If you are a buyer with a problem about an order, contact the store first; if it is not resolved, escalate to us.
8. How we handle reports and orders
We acknowledge complaints within 24 hours and aim to resolve them within 15 days of receipt. Complaints about content that exposes a person's private areas, shows them in full or partial nudity or a sexual act, or is an impersonation in that kind of content are acted on within 24 hours, and requests to remove content in the other categories the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021 specify are acted on within 72 hours.
When we receive an order from a court or a notice from an authorised government agency under the Information Technology Act, 2000 and those Rules, we remove or disable access to the content within 36 hours, or within any shorter time the order sets, and preserve records as the law requires.
When we act on a report we will, where the law allows, tell the store what was reported and what we did, and give it a chance to respond.
9. Enforcement
Depending on how serious the breach is, we may: (1) warn the store and ask it to fix the problem; (2) remove or hide listings, files or content, or restrict features such as messaging, digital products or marketplace listing; (3) suspend the store; (4) terminate the account. For illegal content, risk of harm to people, child sexual abuse material, fraud or a lawful order, we may act at once without a prior warning, and we may report the matter to the authorities.
We will tell the store what we did and why, unless the law prevents us. The store may appeal within 15 days by replying to the notice or writing to the Grievance Officer named at slaby.in/legal/grievance; someone who did not make the original decision will review the appeal.
10. Repeat offenders
Repeated breaches lead to stronger action. A store that keeps breaking this policy, or a person who opens new stores to get around a suspension, may have all of their stores terminated and may be refused a new account.
11. Changes to this policy
We may update this policy, for example when the law changes or new risks appear. Each version is dated and published on slaby.in; store Owners are notified of material changes and asked to accept the new version in the store admin, as described in the Terms of Service.
